Objeto Constitui objeto do presente contrato a prestação de serviço: a) A venda dos seguintes picolés para festa/evento no dia ${fD(e.data)} das ${hrEntrega} às ${hrRetirada}. Com entrega e retirada no endereço ${endEvento}: ${listaItens} b) A título de cortesia, o comodato temporário de 01 carrinho de picolés, 01 Guarda-sol, placas de gelo, que deverão ser devolvidos em até três dias úteis após a realização do evento, sob pena de multa de 20% do valor do contrato em caso de não devolução de qualquer dos itens acima delimitados. (Recomenda-se no máximo 8 horas de utilização dos picolés dentro do carrinho). c) O deslocamento dos produtos, mediante taxa adicional informada por meio eletrônico com uma semana de antecedência ao evento. 2. Do valor do contrato. ${clausula2} ${textoPgto} §2° Em caso de não consumação no evento de todos os picolés vendidos, não há possibilidade de devolução dos itens restantes. §3° Em caso de rescisão contratual por parte do contratante, antes do evento, este receberá os picolés de forma proporcional aos valores adimplidos, sem a possibilidade de devolução dos valores já adimplidos. 3. Obrigações da contratada §1°. Prestar os serviços necessários à consecução do objeto, baseado nas seguintes classificações: a) Entrega dos picolés contratados e aqui descritos. b) Entrega e retirada, mediante taxa, do carrinho de picolés, guarda-sol e placas de gelo. 4. Obrigações do contratante Fornecer a data, o horário e o local do evento, realizar os pagamentos em dia, além de: a) Manter os dados pessoais atualizados, tendo a obrigação de informar imediatamente toda e qualquer alteração de endereço, telefone e e-mail; b) Seguir a recomendação de utilização do carrinho de picolés com as placas de gelo por até no máximo 8 horas para conservação dos picolés. c) Seguir a recomendação de não utilização do carrinho para manutenção de outros produtos que não sejam os licenciados pela UNILEVER BRASIL, sendo o contratante responsável por qualquer ato que venha a ferir a exclusividade. 5. Prazo e cláusula penal É determinado o prazo de duração deste Contrato, até a data do evento realizado ${dataEntrega}, e fica subordinado à conclusão dos serviços contratados. §1° Em caso de rescisão do contrato por parte do contratante, principalmente pelo não pagamento dos valores estipulados, será devida multa de 10% (dez por cento) sobre o valor do contrato, juros de 2% (dois por cento) ao mês e correção monetária pelo índice IGP-M, ou o que vier a lhe substituir em caso de sua extinção. §2° Além de protesto, responderá, o(a) Contratante por todas as despesas com a cobrança de seu débito, incluindo, mas não se limitando, as custas, emolumentos, taxas e honorários profissionais e advocatícios judiciais ou extrajudiciais no valor de 20% do valor atualizado da dívida. §3° É facultado a contratada o envio de cartas de cobrança, efetuar ligações, ou outro meio de comunicação, inclusive eletrônico, visando o recebimento dos valores em atraso. §4° O presente contrato torna-se título executivo extrajudicial e as obrigações aqui assumidas comportam execução específica, na forma prevista no artigo 824 e subsequentes do código de processo civil. 6.
